SG-SST regulations

Current legal framework of the SG-SST in Colombia

The occupational safety and health rules every company must follow, explained for non-lawyers: what each one requires, who it applies to and what changed in 2025 and 2026.

Reviewed on October 30, 2026. General information for companies, not legal advice. Rules change: check the current version with your ARL or with us before making decisions.

How the rules are organized

The SG-SST rests on a pyramid: laws create the occupational risk system and set the sanctions; Decreto 1072 de 2015 regulates how the management system must work; resolutions of the Ministry of Labor set out the minimum standards and the technical topics (medical exams, committees, accidents); and circulars set deadlines and procedures.

The essentials

The core rules

The ones that define what the SG-SST is, who must have one and what happens if it is not met.

Single Regulatory Decree of the Labor Sector

Decreto 1072 de 2015

What it says

It brings together the country’s labor regulations. Book 2, part 2, title 4, chapter 6 (arts. 2.2.4.6.1 to 2.2.4.6.42, which compile Decreto 1443 de 2014) defines the SG-SST: the policy, the obligations of the employer and the ARL, hazard identification, the annual plan, training, emergencies, indicators, the annual audit (art. 2.2.4.6.29) and its scope (art. 2.2.4.6.30), the management review (art. 2.2.4.6.31) and continuous improvement.

What it means for your company

It applies to every public or private employer from the first worker, to anyone hiring people under civil, commercial or administrative contracts, to cooperatives and to temporary staffing companies (art. 2.2.4.6.1). It defines the system as a step-by-step process based on continuous improvement (art. 2.2.4.6.4).

Art. 2.2.4.6.29: “The employer must carry out an annual audit, which will be planned with the participation of the Joint Committee or Vigía.”

Minimum standards of the SG-SST

Resolución 0312 de 2019

What it says

It sets the minimum requirements the Ministry of Labor checks, scaled by size and risk class: 7 standards for companies with up to 10 workers and risk I, II or III (arts. 3 to 7), 21 for those with 11 to 50 (arts. 9 to 14) and 60 for those with more than 50 or risk IV or V (arts. 16 to 22). It defines who can design the system in each case, the 100-point scoring table (art. 27), the self-assessment every December (art. 26), the improvement plans depending on the result (art. 28) and the minimum indicators (art. 30). It repealed Resolución 1111 de 2017.

What it means for your company

It is the checklist you will be measured against. Every December you must assess yourself, draw up the improvement plan, prepare the next year’s annual plan and send a copy to your ARL. If the result is critical (below 60%), the improvement plan is immediate and progress is reported to the ARL within three months; if it is moderately acceptable (60% to 85%), within six.

Minimum profile to design the system: licensed OSH technician (up to 10 workers, risk I to III), licensed technologist (11 to 50) or licensed professional (more than 50 or risk IV and V), always with the 50-hour online course.

General Occupational Risk System

Ley 1562 de 2012

What it says

It amended the occupational risk system created by Decreto Ley 1295 de 1994: it renamed the occupational health program as the Occupational Safety and Health Management System, broadened who must be enrolled and set the sanctions for breaking OSH rules (art. 13): fines of up to 500 monthly minimum wages (SMMLV), up to 1,000 if the breach causes a fatal accident, and closure of the premises when there is a serious risk.

What it means for your company

It is the law that turns the SG-SST into an obligation with consequences. The fines and the Ministry of Labor’s power to close premises come from it.

How fines are scaled

Decreto 472 de 2015

What it says

It regulates how the fines of Ley 1562 are scaled by company size (art. 5, compiled in art. 2.2.4.11.5 of Decreto 1072). It also regulates the closure of the workplace and the suspension of activities when workers are in imminent danger. Amounts are expressed in SMMLV.

What it means for your company

For a micro company (up to 10 workers), the fine for breaking OSH rules ranges from 1 to 5 SMMLV, and from 20 to 24 if there is a fatal accident; for a small company (11 to 50), from 6 to 20 SMMLV, and from 25 to 150 if there is a fatal accident. Medium and large companies reach 100 and 500 SMMLV (400 and 1,000 with a fatal accident).

The foundations

Decreto Ley 1295 de 1994 and Ley 9 de 1979

What it says

Decreto Ley 1295 de 1994 organized the General Professional (now Occupational) Risk System: mandatory enrollment with an ARL, benefits for workplace accidents and occupational diseases, and the employer’s responsibilities. Ley 9 de 1979, the National Sanitary Code, was the first to set occupational health measures in workplaces, in its title III.

What it means for your company

This is where the obligation to enroll your workers with an ARL and pay their contributions according to the company’s risk class comes from.

Technical resolutions

The rules by topic

The resolutions that develop each standard. Several changed in 2025 and 2026.

Occupational medical evaluations

Resolución 1843 de 2025

New in 2025

It replaced Resolución 2346 de 2007 (and Resoluciones 1918 de 2009, 1075 de 1992 and 4050 de 1994). It regulates pre-employment, periodic, exit, post-sick-leave, return-to-work and follow-up medical evaluations, and the handling of the occupational medical record, which the provider keeps for at least 20 years. They are performed by OSH specialist physicians with a valid license. It has been in force since its publication (May 6, 2025) and enforceable since November 7, 2025, after a six-month transition.

For your company: The employer pays for the exams, never the worker. Your SG-SST sets how often they happen based on the risks, and only in exceptional, justified cases can the interval reach three years. The exit exam takes place within five business days after the contract ends.

Workplace harmony committee

Resolución 3461 de 2025

New in 2025

It repealed Resoluciones 652 and 1356 de 2012 and redefines the committee that prevents and handles workplace harassment under Ley 1010 de 2006. It has been in force since its publication (September 11, 2025).

For your company: With fewer than 5 workers, the committee has one workers’ representative and one employer’s representative; with more than 5 and fewer than 20, the same with alternates; with more than 20, two and two with alternates. The term is two years; it meets monthly and holds extraordinary meetings for each complaint. It is not competent to handle sexual harassment.

COPASST and OSH Vigía

Resolución 2013 de 1986

It regulates the Joint Occupational Safety and Health Committee (formerly the joint occupational health committee): an equal number of employer and worker representatives, a two-year term, meetings and duties. Decreto 1072 de 2015 gives it a role in the audit and in accident investigations.

For your company: Companies with fewer than 10 workers appoint an OSH Vigía instead of the committee (Decreto Ley 1295 de 1994, art. 63).

Investigation of workplace incidents and accidents

Resolución 1401 de 2007

It sets the obligations and minimum requirements for investigating workplace incidents and accidents: an investigation team with the direct supervisor, a COPASST representative or the Vigía and the person in charge of the SG-SST, the methodology, the report and the corrective measures. It remains in force and Decreto 1072 refers to it.

For your company: Every incident and accident is investigated within 15 days of occurring (art. 4). The accident is also reported to the ARL and the EPS (health insurer) within two business days (Decreto 1072, art. 2.2.4.1.7).

Psychosocial risk

Resolución 2764 de 2022

Changed

It adopted the battery of instruments to assess psychosocial risk factors, the general technical guide and the intervention protocols, and repealed Resolución 2404 de 2019. The assessment is carried out by a psychologist with an OSH license.

For your company: Identifying psychosocial risk is part of health management in the SG-SST. Under Resolución 2764 de 2022, the assessment is repeated as often as the rule requires for the level of risk found.

Safe work at heights

Resolución 4272 de 2021

It sets the minimum requirements for work at heights (from 2 meters), training by levels, retraining, work permits and fall protection equipment. It repealed Resolución 1409 de 2012 and Resolución 1248 de 2020.

For your company: If anyone in your company works at heights (maintenance, warehouses, façades, roofs), it applies even if only occasionally: certified training, a work permit and the right equipment.

Workplace harassment

Ley 1010 de 2006

It defines workplace harassment, its forms and the preventive and corrective measures the employer must adopt, including a confidential, conciliatory internal procedure (today, the workplace harmony committee of Resolución 3461 de 2025).

For your company: The internal work regulations must include the mechanisms to prevent workplace harassment and the internal procedure to handle complaints.

New in 2026

Circular 0027 de 2026: annual registration of the self-assessment

On February 26, 2026, the Ministry of Labor ordered companies to register the 2025 self-assessment of the minimum standards and its improvement plan in the Occupational Risk Fund application (sgrl.mintrabajo.gov.co), with a deadline of July 31, 2026, under articles 26, 27 and 28 (paragraph 2) of Resolución 0312 de 2019. ARLs must review the self-assessments they receive and report breaches to the Ministry.

  • Every December: run the self-assessment, draw up the improvement plan and prepare the next year’s annual plan.
  • Send a copy of the self-assessment and the improvement plan to the ARL.
  • Every July: send the ARL the progress report on the improvement plan.
  • Register the self-assessment and the plan on the Ministry’s platform by the deadline each circular sets.

The 2026 deadline has passed. If your company did not register its 2025 self-assessment, contact us: we will help you catch up and get the 2026 one ready.
